The Chapter 13 Process

Under Chapter 13, you will propose a plan to repay your creditors over a three- to five-year period. The plan you propose will deal with your various debts, such as tax debts, student loans, creditors with liens against your property, judgments against you, unpaid child support, credit card debt, medical bills, and taxes. Some debts, such as credit cards and medical bills, may be paid only a fraction of what they are owed. When you have completed your payment plan, you will be essentially debt free.

Chapter 13 Gives Debtors Many Options

If you file Chapter 13 bankruptcy, you may have more options than you would under Chapter 7 bankruptcy. For instance, if you have a second mortgage, you may able to remove its lien from your home. This process is known as lien stripping.
